The laws of Albania provide for a 40 hour work week running from Monday through Friday. According to Law No 7961, the standard work day is an eight hour day. The minimum time between work days is 11 hours. There are minimum wages set by government but parties are free to make labour agreements which set the terms of employment. The government establishes national holidays; red-letter days are paid holidays under Albanian law.
Weekly holidays are 36 hours periods that include Sunday. The weekly holiday is not a paid holiday. Employers may not require employees to work on Sundays or official red-lettered days. Employees have a right to full pay for red-lettered days, which if they fall on weekly holiday (Sunday) shall be observed on the following Monday (Article 86).
Employees shall receive increase wages of at least 25 percent for work performed on Sunday or red-lettered days unless otherwise agreed in contract or collective bargaining agreement. Employees shall receive a night differential salary of 25 percent increase for work performed between 2200 hours and 0600 hours on any day except Sunday or red-letter days.
Extra hours are work periods beyond the scheduled daily or weekly amount. Extra hours may not exceed a total of fifty hours per week of regular and extra hours (Article 90).
Employers may request extra hours of work beyond the time set for work each day or week, and during weekly holidays or red-letter days. Extra hours worked must be compensated at a rate at least 25 percent higher than standard pay. Extra hours worked on red-letter or weekly holiday must be compensated at time and one-half or fifty percent over standard wages.
When employers pay for extra hours with holiday time instead of cash, holiday time must be 25 percent longer for extra work, and fifty percent longer for extra work on holidays.
